The liability of Party A according to this Agreement shall be limited to the tripled amount of monthly remuneration paid in the month before the damage occurred. In no event Party A shall be liable to Party B for indirect, incidental or consequential damages, including, but not limited to loss of use, loss of data, loss of production, loss of interest and loss of profit, arising out of, resulting from or incident to performance or non-performance of the Services. Party A shall only be liable for any damage incurred by Party B in case of gross negligence or intent of Party A.
甲方的责任根据本协议应当限于三倍数量的月度薪酬支付损害发生前的一个月。在任何事件应当承担乙方间接、附带或间接损失,包括但不限于使用的损失,损失的数据,生产损失,损失的利息和利润损失,引起的,造成或事件的性能或不履行服务。甲方应赔偿乙方发生的任何损害的重大过失或甲方的意图。
